Kahlúa Espresso Martini Christmas Campaign T&Cs

  1. Open to UK residents aged 18 and over, excluding employees and their immediate families of the Promoter, their agents or anyone professionally connected with the administration of this promotion. Excludes residents of the Isle of Man and Channel Islands.
  2. The promotion shall commence at 12pm GMT on 20th December 2021 and will close at 12am GMT on 31st Dec 2021 (the “Promotional Period”). Entries received outside of the Promotional Period will not be valid.
  3. A registered Twitter or Instagram account is required to enter.
  4. To enter on Instagram, entrants must comment on any grid post which references or depicts an espresso martini with @KahluaUK and #KahluaEspressoMartini. To enter on Twitter, entrants must log into their Twitter account, and comment on an Espresso Martini post with @Kahluauk #KahluaEspressoMartini. One winner per calendar day during the Promotional Period will be chosen from all valid entries received that day by randomised computer process.
  5. Multiple entries are permitted.
  6. Valid entries must be limited to only the content listed at 4. Any entries which contain other content will be disqualified. In particular, entries should not include profanity or offensive or defamatory statements.
  7. By participating in this promotion, you agree to release, discharge and hold the Promoter harmless from any and all injuries, liability, losses and damages of any kind resulting from your participation in this promotion (save that nothing shall limit the Promoter’s liability for fraud, or for death or personal injury caused by its negligence).
  8. Entrants shall indemnify and hold the Promoter and their respective affiliates, directors, agents, or other partners harmless from any claims, actions, proceedings, costs (including legal fees) and expenses brought or asserted by a third party against any of the Indemnitees arising as a result of the Promoter’s use of the entrant’s submission including but not limited to any breach of third party intellectual property rights.
  9. No responsibility will be accepted for any entry that is incomplete or that does not comply with these Terms and Conditions in any way. The Promoter will not be liable for any entries which are deleted by other Instagram users, and such entries will not be entered into the daily draw.
  10. There are 12 prizes to be won in total – one prize per day during the Promotional Period. The prize details are as follows:

  1. In the event of any dispute, the decision of the Promoter is final. No correspondence will be entered. Proof of age may be required. In the event of unforeseen circumstances, the Promoter reserves the right to substitute the prize for an alternative of equal or greater value. No correspondence will be entered into.
  2. The winner will be notified via a direct message on Instagram or Twitter to the account used to make the entry between 4th Jan and 7th Jan. The winner has 24 hours to claim the prize. If the prize goes unclaimed or the winner is unable to redeem the prize, the prize will lapse, and the Promoter reserves the right to offer the prize to an alternative winner in accordance with these terms or not to make further offers of the prize.
  3. All prizes are non-transferable and non-refundable. No cash alternative is available, and no compensation is provided in the event that a winner is unable to redeem the prize. In the unlikely event of the prize or any part of it not being available, the Promoter reserves the right to offer an alternative or equal or similar value.
  4. No applications from agents, third parties, organised groups or entries automatically generated (including, but not limited to, those generated by computer, application, or any type of software) or otherwise outside the instructions or spirit of the promotion will be valid. No incomplete, illegible or corrupted entries or entries not in accordance with the rules will be valid.
  5. If an act, omission, event or circumstance occurs which us beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
  6. Responsibility is not accepted for entries lost, damaged, deleted or delayed as a result of any network, computer hardware or software failure of any kind.
  7. Owing to exceptional circumstances outside its reasonable control and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions at any stage but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  8. By entering the Promotion, all entrants will be deemed to have accepted and be bound by the terms and conditions and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this Promotion and any other purposes to which the entrant has consented.   9. Insofar as is permitted by law, the Promoter, its agents or affiliates will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up or use of the prize except where it is caused by the direct negligence of the Promoter. Your statutory rights are not affected. Promoter shall not be liable for any indirect or consequential losses, nor any loss of profit, goodwill or opportunity.
  10. The Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram or Twitter. The entrant acknowledges that Instagram does not accept any liability whatsoever for any damages which may be incurred as a result of entry into this Promotion. Entrants must adhere to the terms and conditions of use of Instagram.

  12. These terms and conditions and any issues or disputes which may arise out of or in connection with these terms and conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
